1. Acceptance of these Terms
By creating an account, placing an order, selling products, purchasing a membership, or otherwise using the Farm To You website, applications, or services, you agree to these Terms and any policies incorporated by reference. If you do not agree, you may not use the marketplace.
2. The marketplace relationship
The Farm To You ("Farm To You," "we," "us," or "our") operates an online marketplace connecting customers with independent ranchers, farmers, and food producers ("Ranchers"). Unless expressly stated otherwise: products are sold and fulfilled by the Rancher identified on the applicable product page; Farm To You facilitates product discovery, ordering, checkout, payment processing, customer support, and membership administration; Farm To You is not the seller, producer, processor, packager, or shipper of Rancher-listed products; and Farm To You does not take title to or physical possession of Rancher inventory. The purchase agreement for a marketplace product is between the customer and the selling Rancher, subject to these Terms and Farm To You's marketplace policies.
3. Independent Ranchers
Each Rancher is an independently owned and operated business and is not an employee, agent, partner, joint venturer, or legal representative of Farm To You.
- Product legality, safety, quality, and accurate descriptions
- Required licenses, permits, inspections, and insurance
- Inventory availability and pricing
- Processing, preparation, packaging, storage, and fulfillment
- Accurate labeling and legally supportable marketing claims
- Shipping products within the stated fulfillment window
- Responding to customer issues, refunds, recalls, and regulatory matters
- Complying with Farm To You's Food Safety and Quality Standards
Farm To You may establish and enforce marketplace standards but does not assume a Rancher's legal obligations.
4. Customer accounts
Customers must provide current, complete, and accurate information when creating an account or placing an order, and are responsible for maintaining the confidentiality of their login credentials, all activity conducted through their accounts, keeping billing/delivery/contact information current, and promptly notifying Farm To You of suspected unauthorized access. Customers must be legally capable of entering into a binding agreement and meet any applicable minimum-age requirements.
5. Product listings
Ranchers control the products offered through their storefronts and are responsible for the accuracy of their listings. Product photographs are illustrative, and natural products may vary in appearance, size, weight, marbling, color, or packaging. Any permitted weight or quantity variations should be disclosed on the product page. Farm To You may edit, reject, suspend, or remove a listing that violates marketplace standards or applicable law.
6. Orders and acceptance
Submitting an order constitutes an offer to purchase the selected products. An order may be declined or canceled before fulfillment for reasons including product unavailability, pricing or listing errors, payment authorization problems, suspected fraud or unauthorized activity, delivery restrictions, or legal or safety concerns. If a canceled order has already been charged, the appropriate amount will be refunded in accordance with the Refund and Cancellation Policy.
7. Orders from multiple Ranchers
When an order contains products from more than one Rancher, Farm To You creates a separate suborder for each selling Rancher. These suborders may have different processing schedules, shipping charges, tracking numbers, carriers, delivery dates, and packaging methods. Each Rancher's applicable fulfillment information will be displayed through their storefront, product listings, checkout, or order details.
8. Pricing, taxes, and payment
Ranchers generally set the retail prices for their products. Prices, promotions, product availability, and shipping charges may change before an order is placed. Farm To You collects customer payments on behalf of Ranchers using third-party payment providers, then remits eligible proceeds to Ranchers after deducting marketplace commissions, refunds, adjustments, payment-processing charges, and other applicable fees. Customers authorize Farm To You and its payment providers to charge the selected payment method for the total amount displayed at checkout. Applicable taxes and fees will be calculated or estimated at checkout as required, and customers remain responsible for taxes legally imposed on their purchases.
9. Memberships
Farm To You may offer paid membership plans that include benefits such as free or reduced shipping, marketplace discounts, early access, or other benefits. Membership pricing, renewals, cancellations, eligibility, limitations, and refunds are governed by the separate Membership Terms. Membership benefits may be subject to Rancher, product, destination, order-value, or promotional restrictions.
10. Shipping and delivery
Ranchers are responsible for packaging and shipping their products. Processing and delivery dates are estimates unless expressly guaranteed. Customers are responsible for providing a complete and accurate delivery address, monitoring tracking updates, making arrangements to receive perishable deliveries, bringing packages inside promptly, and refrigerating or freezing products according to provided instructions. 11. Cancellations, refunds, and problem orders
Cancellation eligibility depends on whether a Rancher has begun processing the order. Because many marketplace products are perishable or prepared to order, cancellations may not be available after processing begins. Customers must report damaged, improperly thawed, incorrect, incomplete, or materially misrepresented orders within the period stated in the Refund and Cancellation Policy. Available remedies may include a replacement, marketplace credit, partial refund, or full refund, depending on the circumstances.
12. Food safety and allergies
Ranchers must comply with Farm To You's Food Safety and Quality Standards and all applicable legal requirements. Customers are responsible for reviewing product labels, ingredients, allergen disclosures, preparation directions, and storage instructions before consuming a product. Individuals with food allergies or specific dietary requirements should contact the Rancher before ordering if additional information is needed. Customers should not consume any product they reasonably believe may be contaminated, spoiled, improperly handled, or unsafe.
13. Reviews and customer content
Only customers with eligible order activity may submit reviews for a product or Rancher. Reviews and other submitted content must reflect the customer's honest experience, be relevant to the applicable product or Rancher, comply with applicable law, not contain threats, harassment, discrimination, obscenity, confidential information, or knowingly false statements, and not be submitted in exchange for undisclosed compensation or incentives. Ranchers may respond publicly to reviews. Farm To You may remove content that violates these Terms but is not obligated to independently verify every statement. By submitting content, users grant Farm To You a nonexclusive, worldwide, royalty-free license to host, reproduce, display, distribute, and use that content for operating and promoting the marketplace, subject to applicable law and the Privacy Policy.
14. Prohibited conduct
- Use the marketplace for unlawful, fraudulent, or deceptive purposes
- Provide false account, payment, business, or product information
- Interfere with the marketplace's security or operation
- Introduce malicious code or attempt unauthorized access
- Scrape, copy, or exploit marketplace content without authorization
- Misuse customer, Rancher, or platform data
- Circumvent marketplace fees or payment systems for transactions initiated through Farm To You
- Impersonate another person or business
- Violate another party's intellectual-property, privacy, or contractual rights
- Manipulate reviews, transactions, promotions, or referrals
15. Intellectual property
The Farm To You name, branding, website, software, design, text, graphics, and other platform materials are owned by or licensed to Farm To You and are protected by applicable intellectual-property laws. Except as expressly permitted, users may not copy, modify, distribute, sell, license, reverse engineer, or create derivative works from Farm To You's platform or materials. Ranchers retain ownership of their product information and content, subject to the permissions necessary for Farm To You to operate and promote the marketplace.
16. Third-party services
The marketplace may rely on third parties for payment processing, shipping, tracking, analytics, communications, identity verification, and other services. Farm To You is not responsible for a third party's independent acts, omissions, availability, or terms, except to the extent required by law.
17. Account suspension and termination
Farm To You may restrict, suspend, or terminate access to the marketplace when reasonably necessary to enforce these Terms or marketplace policies, address suspected fraud, abuse, or unlawful conduct, protect customers, Ranchers, Farm To You, or the public, respond to food-safety or regulatory concerns, or prevent harm to the marketplace or its systems. Users may stop using the marketplace at any time, subject to outstanding orders, payments, disputes, and other continuing obligations.
18. Disclaimers
To the fullest extent permitted by applicable law, the marketplace is provided on an "as is" and "as available" basis. Farm To You does not guarantee uninterrupted platform availability, continuous product availability, exact delivery dates, or that Rancher-provided descriptions and statements will be error-free. Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.
19. Limitation of liability
To the fullest extent permitted by applicable law, Farm To You will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the marketplace or a Rancher's acts or omissions. Farm To You's responsibility for product-quality and fulfillment issues is generally limited to the remedies available through the Refund and Cancellation Policy, except where applicable law requires otherwise.
20. Indemnification
To the extent permitted by law, Ranchers and other business users may be required to defend, indemnify, and hold Farm To You harmless from claims arising from their products, listings, legal violations, safety failures, fulfillment activities, or breach of these Terms. The scope, procedures, and exceptions for indemnification are established in the applicable Rancher Agreement.
21. Governing law and dispute resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. The parties submit to the jurisdiction and venue of the state and federal courts located in Hillsborough County, Florida, except where applicable consumer-protection law provides otherwise.
22. Changes to these Terms
Farm To You may update these Terms periodically. The revised version will identify its effective date and will be posted through the marketplace. When legally required, Farm To You will provide additional notice or obtain consent before material changes take effect. Continued use after the effective date constitutes acceptance of the revised Terms to the extent permitted by law.
