1. Introduction & Acceptance
Welcome to The Farm To You, Inc. ("The Farm To You," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of our website, mobile experiences, membership services, marketplace, content, and any associated APIs (collectively, the "Service").
By creating an account, becoming a member, placing an order, or otherwise using the Service, you confirm that you are at least 18 years old, have legal capacity to enter into this agreement, and accept these Terms in full. If you do not agree, do not use the Service.
2. Membership Terms
The Farm To You is a members-only marketplace. Non-members may browse certain public content (such as drop teasers, recipes, and farm stories) but may not purchase products or join active waitlists. We offer two membership tiers:
- Standard — $9/month or $99/year. Access to the marketplace at each drop's public release window.
- Premium — $19/month or $199/year. 48-hour early access on every drop, priority checkout, member-only pricing, plus all founding perks during the pre-sale window.
Memberships are personal, non-transferable, and apply to a single household. Sharing account credentials, using bots or automated tools to access drops, or operating multiple accounts to circumvent inventory limits is prohibited and may result in cancellation without refund.
3. Subscription Billing & Renewal
All paid memberships renew automatically at the end of each billing period (monthly or annually) using the payment method on file. Recurring payments are processed by our payment partner Stripe, Inc. By subscribing, you authorize us to charge your payment method on each renewal date until you cancel.
You may cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not issue prorated refunds for partial periods unless required by applicable consumer-protection law (see Refund Policy).
Prices are listed in U.S. dollars and exclude applicable sales tax. We reserve the right to change pricing prospectively; existing subscribers will be notified at least 30 days before any change affects their renewal.
4. Pre-Sale & Founding Member Terms
Prior to our official launch on September 1, 2026, we may offer a pre-sale to a limited number of charter members. Pre-sale subscriptions are billed immediately and grant access to all founding benefits when the Service goes live.
The Founding Member designation is awarded to the first 500 Premium subscribers during a defined pre-sale window. Founding Members receive: a permanent Founding badge on their account, one (1) free cold-chain shipping credit redeemable on a future drop order, priority customer support, and any additional perks announced during the campaign.
Founding status is granted at the moment of successful payment, validated by our payment webhook, and is capped at 500 active accounts. We reserve the right to revoke the designation if the underlying subscription is cancelled, refunded, or charged back.
5. Product Availability & Drops
Our marketplace operates on a drop model: products are released in scheduled, limited-quantity windows rather than maintained as continuous inventory. Each drop has a published release date, total inventory cap, and ending date. Once inventory is exhausted, members may join a waitlist.
All product listings include photos, descriptions, and origin information supplied by the partnering farm. While we take care to present products accurately, slight variations in appearance, size, and seasonal availability are inherent to small-batch agricultural goods.
6. Inventory & Drop Limitations
- Drops are first-come, first-served within each tier's access window. Premium members receive a 48-hour exclusive purchase window before Standard members.
- Reservations are held in your cart for 10 minutes after you add an item; if checkout is not completed, the item returns to general inventory.
- Per-member purchase caps may apply on each drop and are disclosed on the drop page.
- We may, at our sole discretion, cancel an order if we suspect fraud, automated abuse, or violation of these Terms. Any payment captured for a cancelled order will be refunded.
7. Delivery Limitations
We currently ship to street addresses within the contiguous United States. P.O. Boxes, APO/FPO addresses, Alaska, Hawaii, and U.S. territories are not supported at this time. Delivery to remote regions may incur surcharges or longer transit times.
You are responsible for providing an accurate shipping address at checkout. We are not liable for orders shipped to an address you entered incorrectly. If a package is returned to the farm due to an incorrect address, you may be charged for a redelivery attempt.
8. Shipping Policy
This Shipping Policy is part of these Terms and explains how orders are fulfilled, handled, and delivered.
8.1 Delivery Windows
Standard delivery occurs within 2–5 business days from the date a drop ships. Perishable items (such as seafood and chilled meat) ship only on selected days of the week to minimize transit time. The exact ship date for each drop is published on the product page and reaffirmed in your order confirmation.
8.2 Fulfillment Expectations
Each order is fulfilled directly by the originating farm partner. Once your order has been packed by the farm, you will receive an email with the carrier and tracking information. Status updates within your account dashboard follow the lifecycle: Paid → Packed → Shipped → Delivered.
8.3 Farm / Vendor Shipping Responsibilities
Farm partners are responsible for safely packing, labeling, and handing off each order to the carrier within the published handling window. The Farm To You audits packaging standards and provides cold-chain training, but farms operate as independent sellers and retain responsibility for the physical condition of their shipment at the moment of carrier handoff.
8.4 Local Delivery Regions
Where available, we may offer same-day or next-day delivery via local couriers in select metro areas. Local delivery options, if applicable, will be presented at checkout based on your ZIP code.
8.5 Cold-Chain Handling Disclaimer
Perishable products are shipped with insulated packaging and refrigerant gel packs sized for the published transit time. Once delivered, you are responsible for promptly retrieving and refrigerating the package. We are not responsible for product spoilage caused by a package left unattended at the delivery address beyond a reasonable retrieval window.
8.6 Shipping Delays
Carrier delays, even when significant, are not always within our control. We will work with you and the carrier in good faith to resolve any service issues, including arranging replacements or credits where appropriate (see Refund Policy).
8.7 Weather, Wildfire & Force Majeure Delays
Severe weather, wildfires, public-health events, labor strikes, and other force-majeure circumstances may cause delays or service interruptions in specific regions. When such conditions threaten product integrity, we reserve the right to delay shipment to your area until the cold chain can be reliably maintained, and we will notify affected customers in advance.
8.8 Split Shipments
Orders that include items from more than one farm partner will ship as separate packages. Each shipment receives its own tracking number and may arrive on different days. The "Delivered" status on your overall order is set only after every shipment has been delivered.
8.9 Tracking Expectations
Tracking information is provided as soon as the originating farm hands the package to the carrier. Tracking may take up to 24 hours to populate carrier systems after the handoff event. If your tracking has not updated within 48 hours of receiving a shipment email, please contact us via the Contact page.
9. Refund Policy
This Refund Policy is part of these Terms. Because our products are fresh, perishable, and drawn from extremely limited inventory, our refund policy is designed both to protect our members and to keep the business sustainable for the small farms we partner with.
9.1 Membership Refunds
- Monthly memberships — non-refundable once a billing period has begun. You may cancel at any time, and your access continues until the end of the current period.
- Annual memberships — refundable within 14 days of the original purchase, provided no drop, recipe access, or member-only benefit has been redeemed during that window. After 14 days, annual memberships are non-refundable but remain active and benefit-bearing until expiry.
- Founding-Member status is automatically rescinded upon refund of the originating Premium subscription.
9.2 Subscription Cancellation
Cancellation is self-service from your account dashboard and takes effect at the end of the current billing period. No fees, penalties, or "win-back" hurdles apply.
9.3 Perishable Item Refund Limitations
Because of the perishable, single-batch nature of our products, we generally do not accept returns of physical goods. Refunds, credits, or replacements may be offered in the specific scenarios described below.
9.4 Damaged, Spoiled, or Missing Items
If a product arrives damaged, spoiled at delivery, or is missing from your order, please contact us within 48 hours of the carrier's "Delivered" timestamp with clear photos of the issue and the packaging. After review, we will provide one of the following remedies at our discretion:
- A full refund of the affected item(s) to the original payment method;
- An equivalent-value store credit toward a future drop;
- A replacement on the next available comparable drop (subject to inventory).
9.5 Replacement & Credit Policies
Store credits issued in lieu of refunds are valid for 12 months from issuance, are non-transferable, and may not be combined with promotional discounts. Replacement shipments are subject to the same shipping schedule as the original drop and may ship on a future date.
9.6 Non-Refundable Product Categories
The following are non-refundable once a tracking number has been issued, unless the item arrives damaged or spoiled and is reported within the window described in 9.4:
- Raw and prepared seafood, fish filets, and shellfish;
- Whole-bird poultry, ground meats, and raw cuts (beef, pork, bison, turkey, chicken);
- Bacon, breakfast meats, and ready-to-cook protein boxes;
- Custom-curated or chef-curated boxes that have already been packed.
9.7 Delivery Issue Reporting Windows
- 48 hours after the carrier "Delivered" timestamp — to report damage, spoilage, or missing items.
- 5 business days after the expected delivery date — to report a lost shipment that never arrived.
Reports received after these windows may not qualify for a refund or replacement, although we always review individual circumstances in good faith.
9.8 How to Request a Refund
All refund and replacement requests must be submitted through the Contact page or by replying to your order-confirmation email. Please include your order number and clear photographs of any product or packaging issue. Refunds are typically processed within 5–10 business days after approval.
10. Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at the Contact page if you suspect unauthorized access. We are not liable for losses resulting from your failure to secure your credentials.
11. User Conduct
You agree not to: (i) use the Service for any unlawful purpose; (ii) attempt to gain unauthorized access to any portion of the Service or its underlying systems; (iii) deploy bots, scrapers, or automation that interferes with normal operation; (iv) resell products purchased through the Service in any commercial context; or (v) harass, abuse, or harm other members, farm partners, or our employees.
12. Intellectual Property
All content on the Service — including text, photography, logos, recipes, designs, software, and the "The Farm To You" name and marks — is owned by The Farm To You, Inc. or its licensors and is protected by U.S. and international intellectual-property laws. You receive a limited, non-exclusive, non-transferable license to access the Service for personal use only. No content may be copied, redistributed, or used to train machine-learning models without our prior written permission.
13. Vendor & Farm Fulfillment Disclaimers
The Farm To You operates as a curated marketplace between members and independent farm partners. While we vet every partner, set quality standards, and require cold-chain training, each farm remains an independent business responsible for the lawful production, labeling, and shipment of its products.
The Farm To You makes no representation or warranty regarding any specific farm's compliance with state-level food-safety regulations, kosher or halal certification, or organic certification beyond what is publicly displayed on the listing. Members with allergies or specific dietary restrictions should review each product page carefully and contact the farm directly via the Contact page for additional details.
14. Limitation of Liability
To the maximum extent permitted by law, The Farm To You, its affiliates, officers, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service or any product purchased through it.
Our aggregate liability for any claim arising out of or relating to the Service is limited to the total amount you paid to The Farm To You in the twelve (12) months immediately preceding the event giving rise to the claim, or $100, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising out of these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Wilmington, Delaware. You and The Farm To You waive any right to a jury trial or to participate in a class action.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email and posted at the top of this page with a revised "Last updated" date. Continued use of the Service after a change takes effect constitutes your acceptance of the updated Terms.
